ZusammenfassungDie Odysseus-Verfügung ist als besondere Form der Patientenverfügung zumindest in der Literatur hinlänglich bekannt. Die Verwendung des Begriffs und damit sein Gegenstandsbereich sind hingegen noch immer umstritten. Zudem wird oft nicht beachtet, dass es innerhalb dieses Gegenstandsbereichs Varianten von OVs zu differenzieren gilt, die sich auch in ihrer moralischen Rechtfertigung unterscheiden. Nicht zuletzt ist die Grundstrukturstruktur dieser Rechtfertigung umstritten. Vor diesem Hintergrund plädieren wir im Folgenden zunächst für eine Eingrenzung des Begriffs, mit der argumentative und klinisch-praktische Verwirrungen vermieden werden können. (...) Anschließend betrachten wir zwei Varianten von – Zwang legitimierenden – OVs, die sich in der individuellen Kompetenz des Destinatärs unterscheiden. Schließlich zeigen wir, dass deren Rechtfertigung ungeachtet des Umstandes, dass OVs auf Wiedererlangung der Urteils- und Steuerungsfähigkeit des Patienten angelegt sind, weder in einer gemutmaßten noch gar in einer faktischen retrospektiven Billigung von Zwang durch den Patienten liegt. Die primäre Legitimationsgrundlage von OVs besteht vielmehr in der ex ante erfolgenden Autorisierung durch den Betroffenen selbst. Die hier einzuräumende Autorität wiederum basiert auf dem Recht jeder Person auf lebensplanerische Selbstbestimmung. In einem kurzen abschließenden Teil skizzieren wir dann noch die besondere Bedeutung der Odysseus-Vereinbarung als einer Unterform der OV. (shrink)

Zusammenfassung Personen, die nicht bereits sind, als postmortale Organspender zur Verfügung zu stehen, sollten nachrangig versorgt werden, falls sie selbst einmal ein Organ benötigen, so wird in diesem Aufsatz argumentiert. Postmortale Organspenden sollten demnach grundsätzlich gerichtete Spenden zugunsten von anderen Spendewilligen sein. Diesem Ansatz zufolge sollten Organe nicht als öffentliche Ressource betrachtet werden und der Staat sollte respektieren, dass die Entscheidung darüber, was nach dem Tod mit dem Körper geschehen soll, bei der betreffenden Person selbst liegt. Während einige Formen der (...) gerichteten Spende moralisch problematisch sein können, ist ein allgemeines System von gerichteten Spende an andere Spendewillige diesem Vorschlag zu folge moralisch erlaubt, weil es die Grundsätze der Autonomie- Achtung, der Reziprozität sowie der Solidarität wahrt und niemanden unangemessenen Schwierigkeiten aussetzt, der im Notfall keine schlechteren Aussichten auf ein Spenderorgan haben möchte. § 219a of the German Penal Code (StGB) – the so-called ban on advertising abortions – has been subject of an increasing legal-political controversy since 2017 and was dropped by legislation in July 2022. This paper examines and reconstructs the extent to which the aforementioned ‘ban on advertising’ was (in–)‌compatible with recognized standards of medical ethics. For this purpose, arguments put forward in public discourse on both sides of the conflict, insofar as they go beyond basic attitudes toward abortion, will (...) be subjected to a plausibility test from the perspective of medical ethics. This will show that (I.) according to the standard understanding of autonomy in medical ethics by Beauchamp and Childress, the provision of information about abortions is not an undue influence, but a necessary precondition for autonomous decisions by pregnant women; that (II.) the feared undesirable social developments after the abolition of § 219a StGB are empirically unfounded and largely implausible; but that on the other hand (iii) a multi-perspective communication landscape with accessible expert information promises to effectively counteract the self- and external stigmatization of unintentionally pregnant women. As a result, this analysis provides two things: a coherent medico-ethical justification for the annulment of § 219a StGB and an argumentative basis for the defense against future efforts to support biopolitical positions by censoring available information. BackgroundVast sums are distributed based on grant peer review, but studies show that interrater reliability is often low. In this study, we tested the effect of receiving two short individual feedback reports compared to one short general feedback report on the agreement between reviewers.MethodsA total of 42 reviewers at the Norwegian Foundation Dam were randomly assigned to receive either a general feedback report or an individual feedback report. The general feedback group received one report before the start of the reviews (...) that contained general information about the previous call in which the reviewers participated. In the individual feedback group, the reviewers received two reports, one before the review period and one during the period. In the individual feedback group, the reviewers were presented with detailed information on their scoring compared with the review committee as a whole, both before and during the review period. The main outcomes were the proportion of agreement in the eligibility assessment and the average difference in scores between pairs of reviewers assessing the same proposal. The outcomes were measured in 2017 and after the feedback was provided in 2018.ResultsA total of 2398 paired reviews were included in the analysis. There was a significant difference between the two groups in the proportion of absolute agreement on whether the proposal was eligible for the funding programme, with the general feedback group demonstrating a higher rate of agreement. There was no difference between the two groups in terms of the average score difference. However, the agreement regarding the proposal score remained critically low for both groups.ConclusionsWe did not observe changes in proposal score agreement between 2017 and 2018 in reviewers receiving different feedback. The low levels of agreement remain a major concern in grant peer review, and research to identify contributing factors as well as the development and testing of interventions to increase agreement rates are still needed.Trial registrationThe study was preregistered at OSF.io/n4fq3. Objective The objective of this article is to provide an ethical analysis of a high-risk, advanced treatment case where the patient received transcatheter aortic valve insertion, for aortic valve stenosis. Particular emphasis will be placed upon the significance of evidence and the implications for priority setting. Method One paradigmatic case involving a TAVI patient from a large university hospital in Norway is described and analysed. The method used was ethical case analysis modified after Kymlicka by Miljeteig et al. Perioperative mortality (...) risk was estimated using the Euroscore risk-logarithm and the Society of Thoracic Surgeons’ risk model, STS. These predict the risk of operative mortality and morbidity associated with adult cardiac surgery. GRADE, the Grading of Recommendations Assessment, Development and Evaluation, was used to evaluate the evidence. Results In the case analysis, we found that it would be ethically justifiable not to recommend TAVI treatment for this patient. Although the patient had a severe condition in need of treatment, the expected improvement was marginal, the quality of evidence was low and the opportunity costs for other patients and society were higher than usually deemed appropriate. Conclusions Decision-making in the absence of high quality evidence from randomized trials is a complex process involving difficult ethical judgments. Novel high-risk devices often enter the European market with limited clinical evidence. Transparency and improved clinical evaluation are required so patient safety is not jeopardized. We argue that implementation of high risk, high cost interventions should be better regulated at a national level. Background All clinical decisions imply priority setting and therefore indirectly affect other patients and other patient groups. The use of expensive, innovative health technologies has an affect on individual patients as well as on other patient groups competing for the same resources. (shrink)

Pascalův argument je reformulován tak, aby těmto námitkám co nejlépe odolal. Analýza ukazuje, že revidovaná podoba sázky zůstává otevřeným problémem teorie rozhodování.The article analyzes some important reasons pro and contra Pascal`s wager argument. Many gods objection and objections by Antony Duff and Alan Hájek are discussed. A reformulation of Pascal`s wager is offered in order to make the case (...) for Pascal`s conclusion stronger. It is shown that some form of wager could still represent a serious problem for rational decision theory. (shrink)

This vision of modern Czech society rested on the ideals of humanity, thus infusing the national ethos with a universal dimension. The significance of T. G. Masaryk's thought is investigated by current Czech thinkers in this volume.

The Anthropocene concept arose within the Earth System science community, albeit explicitly as a geological time term. Its current analysis by the stratigraphical community, as a potential formal addition to the Geological Time Scale, necessitates comparison of the methodologies and patterns of enquiry of these two communities. One means of comparison is to consider some of the most widely used results of the ESS, the ‘planetary boundaries’ concept of Rockström and colleagues, and the ‘Great Acceleration’ graphs of Steffen and colleagues, (...) in terms of their stratigraphical expression. This expression varies from virtually non-existent to pronounced and many-faceted, while in some cases stratigraphical proxies may help constrain anthropogenic process. The Anthropocene concepts of the ESS and stratigraphy emerge as complementary, and effective stratigraphic definition should facilitate wider transdisciplinary communication. (shrink)

The concept of a socially extended mind suggests that our cognitive processes are extended not simply by the various tools and technologies we use, but by other minds in our intersubjective interactions and, more systematically, by institutions that, like tools and technologies, enable and sometimes constitute our cognitive processes. In this article we explore the potential of this concept to facilitate the development of a critical neuroscience. We explicate the concept of cognitive institution and suggest that science itself is a (...) good example. Science, through various practices and rules, shapes our cognitive activity so as to constitute a certain type of knowledge, packaged with relevant skills and techniques. To develop this example, we focus on neuroscience, its cultural impact, and the various institutional entanglements that complicate its influence on reframing conceptions of self and subjectivity, and on defining what questions count as important and what kind of answers will be valued. Since the Niels Bohr centenary of 1985 there has been an astonishing international surge of scholarly analyses of Bohr's philosophy. Now for the first time in Niels Bohr and Contemporary Philosophy Jan Faye and Henry Folse have brought together sixteen of today's leading authors who have helped mould this new round of discussions on Bohr's philosophy. In fifteen entirely new, previously unpublished essays we discover a surprising variety of the different facets of Bohr as the natural philosopher whose `framework of (...) complementarity' shaped the final phase of the quantum revolution and influenced two generations of the century's leading physicists. There is much on which the authors included here agree; but there are also polar disagreements, which assure us that the philosophical questions revolving around Bohr's `new viewpoint' will continue to be a subject of scholarly interest and discussion for years to come. Nowadays there are many spaces of fascination in visual art. Of course, installative space and contextual space have been on the art scene for awhile. However, they are now accompanied by other spaces such as urban space, architectural space, cyberspace, hyperspace, and screen-based space. In this volume, architects, artists, theorists, three symposia and four exhibitions attempt to find answers to questions such as: Could the architectonic study and/or deconstruction of space play a decisive role in the shift of attention to (...) space? Which theoretical factors structure the current experience and meaning of space? What is the role of the aesthetization of the environment on our concept of space? Smooth Space - VCC de Brakke Grond, Amsterdam - is a project at the heart of this publication. Spatial interests range from how the concept of space is redefined and exploited in our current visual culture to how the digital world influences our spatial concepts. The book gives an painstaking analysis of Niels Bohr's understanding of quantum mechanics based on a claim that Bohr was influenced by Harald Høffding's approach to philosophical problems.

The last decade has seen an increasing number of references to quantum mechanics in the humanities and social sciences. This development has in particular been driven by Karen Barad’s agential realism: a theoretical framework that, based on Niels Bohr’s interpretation of quantum mechanics, aims to inform social theorizing. In dealing with notions such as agency, power, and embodiment as well as the relation between the material and the discursive level, the influence of agential realism in fields such as feminist science (...) studies and posthumanism has been profound. However, no one has hitherto paused to assess agential realism’s proclaimed quantum mechanical origin including its relation to the writings of Niels Bohr. This is the task taken up here. We find that many of the implications that agential realism allegedly derives from a Bohrian interpretation of quantum mechanics dissent from Bohr’s own views and are in conflict with those of other interpretations of quantum mechanics. Agential realism is at best consistent with quantum mechanics and consequently, it does not capture what quantum mechanics in any strict sense implies for social science or any other domain of inquiry. Agential realism may be interesting and thought provoking from the perspective of social theorizing, but it is neither sanctioned by quantum mechanics nor by Bohr’s authority. This conclusion not only holds for agential realism in particular, it also serves as a general warning against the other attempts to use quantum mechanics in social theorizing. (shrink)

On the standard interpretation, if a person holds cyclical preferences, the person is prone to acting irrationally. I provide a different interpretation, tying cyclical preferences not to irrationality, but to indecision. According to this alternative understanding – coined the indecision interpretation – top cycles in a person’s preferences can be associated with a difficulty in justifying one’s choice. If an agent’s justificatory impasse persists despite attempts to resolve the cycle, the agent can be deemed undecided. The indecision interpretation is compatible (...) with the standard interpretation of such cycles as instances of irrationality. Yet indecision corresponds to a first-person, non-instrumental perspective on the problem, whereas irrationality usually corresponds to a third-person, instrumental perspective. Due to these differences, interpreting cycles in terms of indecision offers a novel conceptual perspective, pertinent both for explanatory purposes and for the aim of normative theorizing. (shrink)

The bulk of the present book has not been published previously though Chapters II and IV are based in part on two earlier papers of mine: "The Influence of Harald H!1lffding's Philosophy on Niels Bohr's Interpretation of Quantum Mechanics", which appeared in Danish Yearbook of Philosophy, 1979, and "The Bohr-H!1lffding Relationship Reconsidered", published in Studies in History and Philosophy of Science, 1988. These two papers comple ment each other, and in order to give the whole issue a more extended treatment (...) I have sought, in the present volume by drawing on relevant historical material, to substantiate the claim that H!1lffding was Bohr's mentor. Besides containing a detailed account of Bohr's philosophy, the book, at the same time, serves the purpose of making H!1lffding' s ideas and historical significance better known to a non-Danish readership. During my work on this book I have consulted the Royal Danish Library; the National Archive of Denmark and the Niels Bohr Archive, Copenhagen, in search of relevant material. I am grateful for permission to use and quote material from these sources. In the 20th century, the term “media logic” was introduced to denote the influence of independent mass media on political systems and other institutions. In recent years the idea has been reworked and labeled “mediatization” to widen the framework by including new media and new areas of application. In Section Two the paper discusses different conceptualizations. It is argued that even if they bring new insights, they cannot be unified into one concept, and that they also lack a consistent definition (...) of digital media. Section three provides a definition of digital media in order to identify new trajectories made possible by these media, which have led into a new media matrix built around the internet and mobile devices. It will be argued that the new media matrix cannot be understood from a point of view defined by the framework of 20th century mass media because digital media open new trajectories and because in the new matrix the previously existing media have had to transform themselves. Logical consequence is the relation that obtains between premises and conclusion(s) in a valid argument. Orthodoxy has it that valid arguments are necessarily truth-preserving, but this platitude only raises a number of further questions, such as: how does the truth of premises guarantee the truth of a conclusion, and what constraints does validity impose on rational belief? This volume presents thirteen essays by some of the most important scholars in the field of philosophical logic. The essays offer ground-breaking new insights (...) into the nature of logical consequence; the relation between logic and inference; how the semantics and pragmatics of natural language bear on logic; the relativity of logic; and the structural properties of the consequence relation. This paper makes the case for a sharper terminology regarding AIs cognitive abilities. In arguing that thinking requires more than content production, I offer a definition of meaning drawing on a clear distinction between living and machine intelligence. A pivotal argument is the re-use of the Turing Test (TT) for understanding which theories of meaning and consciousness are no longer plausible—because they have been reproduced by software without thereby gaining conscious experience. In following the few theories that have not (yet) (...) failed this reversed Turing Test (RTT), the focus turns towards rethinking the human condition in times of AI along the lines of three questions: What if a machine developed consciousness? What if AI proceeded without developing a consciousness? What, if machinic and human intelligence merged? These three questions in the end lead to examining three related possible futures of humanism as now determined by the relation between Human Intelligence and AI. (shrink)

Meetings differ from ordinary conversation in that they have an agenda that specifies in advance the topics to be addressed during the meeting. However, the introduction of these topics needs to be locally accomplished and recognized by the participants as agenda items. This article presents some characteristic practices used for introducing agenda-based topics. It shows that they rely on the known-in-advance status of the items, and are presented by the chair as unilateral announcements. They exploit and invoke the written agenda (...) in several ways. The announcements are often short phrasal constructions, just citing the written title of the agenda point. Furthermore, a gaze down at the written document is used as a public display that the introduction is related to the agenda. In contrast to this practice of introducing agenda items, topics not specified by the agenda are introduced by suggestions and questions that present the introduction as contingent on acceptance by the co-participants. The analysis sheds light on the ways in which institutional talk-in-interaction is permeated by the formulations and logic of written documents. (shrink)

It seems that the reception of Conrad Hal Waddington’s work never really gathered speed in mainstream biology. This paper, offering a transdisciplinary survey of approaches using his epigenetic landscape images, argues that (i) Waddington’s legacy is much broader than is usually recognized—it is widespread across the life sciences (e.g. stem cell biology, developmental psychology and cultural anthropology). In addition, I will show that (ii) there exist as yet unrecognized heuristic roles, especially in model building and theory formation, which Waddington’s images (...) play within his work. These different methodological facets envisioned by Waddington are used as a natural framework to analyze and classify the manners of usage of epigenetic landscape images in post-Waddingtonian ‘landscape approaches’. This evaluation of Waddington’s pictorial legacy reveals that there are highly diverse lines of traditions in the life sciences, which are deeply rooted in Waddington’s methodological work. (shrink)

It has seen not only a proliferation of logical systems, but new applications of a wide range of different formal theories to philosophical questions. As a result, philosophers have been forced to revisit the nature and foundation of core logical concepts, chief amongst which is the concept of logical consequence. Sometimes also called retro causation. A common feature of our world seems to be that in all cases of causation, the cause and the effect are placed in time so that the cause precedes its effect temporally. Our normal understanding of causation assumes this feature to such a degree that we intuitively have great difficulty imagining things differently. The notion of backward causation, however, stands for the idea that the temporal order of cause and effect is a mere contingent feature (...) and that there may be cases where the cause is causally prior to its effect but where the temporal order of the cause and effect is reversed with respect to normal causation, i.e. there may be cases where the effect temporally, but not causally, precedes its cause.
